KRA Intercepts Undeclared Smartphones Worth Over Ksh 16 Million at Eldoret International Airport

The Kenya Revenue Authority (KRA) enforcement teams intercepted an undeclared consignment of 21,600 units of high-end smartphones, with a tax value of Ksh 16,102,137, at the Eldoret International Airport.

The consignment was part of consolidated items that included 5,000 declared units of smartphones worth Ksh 6.4 million, as well as shoes, clothes, auto spare parts, household items, and other electronic accessories. The operation was successful following an intelligence-led report.

The intercepted consignments were consigned to Pemba Cargo Limited and declared by Portyard Limited through a cargo plane that arrived on 18th September 2025. Investigations have revealed that the goods were declared either expressly or under consolidated cargo in different categories.

This tax evasion scheme contravenes Section 203 of the East African Community Customs Management Act (EACCMA), 2004, which provides that:

“A person who, in any matter relating to the Customs, makes any entry which is false or incorrect in any particular, or in any way is knowingly concerned in any fraudulent evasion of the payment of any duty commits an offence and shall be liable on conviction to imprisonment for a term not exceeding three years or to a fine not exceeding ten thousand dollars.”

KRA remains committed to unearthing tax evasion schemes in order to boost revenue compliance and ensure adherence to tax laws and procedures. These enforcement measures are crucial in safeguarding government revenue and maintaining a fair trading environment within the market.

Dear Younger Me,

You think you’re walking this life alone — a single player in a private game. But life’s trickier than that. There are coaches calling from the sidelines, rivals making moves you don’t yet see, and quiet allies shifting pieces in your favour without you knowing. The board doesn’t reset after each turn. It remembers every risk, hesitation, and leap. And so will you.

Heraclitus once said you can’t step into the same river twice — not because the water changes, but because you do. Every decade, the river will carry you somewhere new.

You’re stepping into adulthood with equal parts ambition and dread. Everything is new — first apartment, first real pay cheque, first time you realise the rent is due even when you’re sick.

2002.The dealership floor gleams under fluorescent lights, the air heavy with polish and fresh leather. The modest sedan waiting for you isn’t just transportation — it’s independence on four wheels. As your pen scratches across the finance papers, your pulse drums in your ears. Each signature feels like both a key and a chain.

Two years later, 2004, you stand at a crossroads. The Kenya Revenue Authority Graduate Trainee Programme offers a path of service — an invitation to join the guardians of national revenue. Yet, an international multinational dangles six-figure numbers that glitter brighter in the moment. You choose the latter, convincing yourself it’s the wiser play, while whispering silent prayers that one day, God will open a door for you to serve “the punter” — the everyday taxpayer — with the tax passion you can’t quite shake.

You’ll stumble — hard — and more than once. But you’ll learn that mistakes, as humiliating as they feel in the moment, are your first honest teachers. Aristotle was right: “The roots of education are bitter, but the fruit is sweet.”

It melts under the heat of rent, utilities, and the emergency repair for that car you once admired in the showroom. Friendships will deepen if you feed them; they’ll vanish quietly if you don’t. You’ll learn that saying yes to everything leaves no room for the things that actually matter.

But there will be moments that make the grind worthwhile — like the day your name is called for the Dr. Manu Chandaria Award, recognising not just your technical skill but the grit and late nights behind it. Or when you step forward to receive ICPAK’s national awards for top CPA Section 5 and Section 6 candidates — tangible proof that you could not only play in one of the toughest professional arenas, but master it.

It’s a slower, steadier decade. Less sprint, more marathon. You’ll start craving quality — in people, work, and how you spend a Sunday afternoon.

And one day, the door you prayed for years ago opens — the call to serve the taxpayer directly, aligning with KRA’s vision “to be a globally trusted revenue agency, facilitating tax and customs compliance”. You find yourself living the values you once only read about: integrity, professionalism, equity, and trust. It’s more than a job — it’s the merging of your skill with your sense of civic duty.

You start letting go — not as surrender, but as skill.
KRA’s Perspective on the Burden and Standard of Proof in Tax and Customs Cases

By CS Paul Muema Matuku EBS

Introduction

Taxation is fundamental to government revenue generation, yet disputes over tax assessments frequently arise. In Kenya, tax litigation is primarily handled by the Tax Appeals Tribunal (TAT) at the first instance and thereafter appeals lie with the High Court, and the Court of Appeal. Two legal principles are key to these disputes, these being: the burden of proof and the standard of proof. The burden of proof determines which party—either the taxpayer or the Kenya Revenue Authority (KRA)—must substantiate their claims, while the standard of proof defines the level of certainty required for a claim to be upheld.

This article critically examines these principles as applied in Kenyan tax law, drawing from statutory provisions, case law, and practical implications in tax administration. It also explores how these concepts shape tax compliance and enforcement and discusses instances where the burden shifts like a swinging pendulum between parties.

The Burden of Proof in Tax Cases

Section 56 of the Tax Procedures Act which falls under Part VIII ‘on Tax Decisions, Objections and Appeals’ provides for the burden of proof in tax disputes as follows:

"In any proceedings under this Part, the burden shall be on the taxpayer to prove that a tax decision is incorrect."

Similarly, Section 30 of the Tax Appeals Tribunal Act reinforces this principle, stating that the appellant (usually the taxpayer) must prove:

That an assessment is excessive, or

That a tax decision should not have been made or should have been made differently.

In tax matters, it is now settled that the burden of proof swings between the taxpayer and the taxman, but is mostly on the taxpayer.

Burden of Proof in Customs Cases

Under section 223 of the East Africa Community Customs Management Act (EACCMA, 2004) the issue of burden of proof is clearly spelt out as follows;

‘In any proceedings under this Act-

(a) the onus of proving the place of origin of any goods or the payment of the proper duties, importation, landing, removal, or the lawful conveyance, exportation, carriage coast- wise, or transfer, of any goods shall be on the person prosecuted or claiming anything seized under this Act;’

Further sub-section (b) affirms that ‘the averment by the Commissioner on any matter or document shall be prima facie evidence of such fact;’

These provisions establish the presumption of correctness, meaning that KRA’s tax assessments are deemed valid unless the taxpayer provides incontrovertible evidence. The rationale behind this presumption is:

KRA’s tax assessments are presumed to be based on statutory obligations.

Governments require a reliable revenue stream for public services.

Taxpayers have the primary access to documentation that can support their claims.

Judicial Interpretation of the Burden of Proof for Customs cases

Several court decisions in Kenya and other East African Community (EAC) member states have reinforced the principle established in Section 223 of the EACCMA 2004 that once the Commissioner alleges non-compliance with customs laws, the accused must provide sufficient proof to the contrary. In the cases of Kenya Revenue Authority v. Export Traders Limited (2020), the Kenyan High Court ruled that in cases where the KRA alleged mis-declaration of imports, the burden was on the trader to prove the correct classification and origin of the goods. The court emphasized that the law presumes customs authorities' records to be correct unless proven otherwise.

In the Tanzanian Case of Republic v. Hassan Ali (2019), the Tanzanian Court of Appeal upheld the seizure of imported motor vehicles for which proper duty documentation was lacking and duty not paid. The accused person failed to provide evidence of duty payment, and the court ruled that the presumption of illegality stood unchallenged under Section 223 of EACCMA 2004. Further, in the case of Uganda Revenue Authority v. Diamond Trust Bank Uganda Ltd (2021), Uganda’s Tax Appeals Tribunal held that once the customs authority asserts that duties were unpaid, the responsibility shifts to the importer to demonstrate full compliance with customs regulations.

Judicial Interpretation of the Burden of Proof for tax cases

While the burden of proof in tax initially rests on the taxpayer, it is not absolute. Under certain circumstances, the burden may shift to KRA, particularly in cases involving fraud or improper tax assessments.

Kenyan courts have extensively ruled on the burden of proof in tax matters. A review of key cases provides insights into its practical application.

Burden of proof in tax disputes

In tax disputes, the burden of proof can shift between the taxpayer and the tax authority, resembling the motion of a pendulum. The High Court of Kenya in the case of Commissioner of Investigations and Enforcement v Pearl Industries Limited (Tax Appeal E086 of 2020) articulated this concept. The court observed as follows:

"…In this case, the pendulum of proof swung three times; the first was upon the Respondent (Pearl Industries Ltd), which it did by providing the documents requested by the Commissioner; the second shifted to the Commissioner, who after reviewing the documents challenged their authenticity and validity. This meant that the burden of proof finally swung back to the Respondent to prove that the Commissioner was wrong in its position and overall findings."

The above analogy underscores the dynamic nature of the burden of proof in tax disputes, highlighting that it may shift between parties as evidence is presented and contested.

In Kenya Revenue Authority v Maluki Kitili Mwendwa [2021] KEHC 4148 (KLR), the High Court reaffirmed that the taxpayer must present competent and verifiable evidence to challenge a tax assessment. The court emphasized that the presumption of correctness applies unless rebutted.

Similarly, in Kenya Revenue Authority v Man Diesel Turbo Se Kenya, [2021] KEHC 13347 (KLR) the court outlined three justifications for placing the burden on taxpayers:

Presumption of Correctness – KRA’s assessments are valid unless proven otherwise.

Government’s Need for Revenue – Tax collection is crucial for national economic sustainability.

Taxpayer’s Possession of Evidence – Since taxpayers control their financial records, they must substantiate their tax positions.

Circumstances When the Burden May Shift

Although the burden primarily rests on the taxpayer in both tax and customs cases, courts have identified scenarios where it can shift to KRA.

In Commissioner of Domestic Taxes v Metoxide Limited, [2022] KEHC 14613 (KLR) the court ruled that while taxpayers must initially provide documentation supporting their tax positions, if KRA challenges the validity of the documents, the burden shifts back to the taxpayer to provide additional supporting evidence.

A similar approach was taken in Commissioner of Domestic Taxes v Structural International Kenya Ltd, [2021] KEHC 152 (KLR) where the court held that if KRA disputes the authenticity of transactions, the taxpayer must produce additional records such as stock movement documents and bank statements.

In Commissioner of Investigations and Enforcement v Pearl Industries Limited, (Supra) KRA established a prima facie case of tax fraud. The court ruled that where fraud is alleged, the taxpayer must provide clear and convincing evidence to disprove the claims.

Procedural Fairness and Transparency

While the burden of proof generally lies with the taxpayer, courts have ruled that KRA must act transparently and provide clear reasons for its tax assessments. In Equity Group Holdings Limited v Commissioner of Domestic Taxes, 2021] KEHC 25 (KLR) the High Court held that KRA cannot impose tax liabilities arbitrarily and must disclose the rationale behind its decisions.

Similarly, in Commissioner of Domestic Taxes v Galaxy Tools Limited, [2021] KEHC 5530 (KLR) the court emphasized that once a taxpayer provides sufficient proof of compliance; KRA must counter with substantive evidence rather than assumptions.

Standard of Proof in Tax Cases

The standard of proof in tax disputes refers to the level of evidence required to convince a court or tribunal of a claim. In tax matters, the applicable standard varies depending on the nature of the case.

Balance of Probabilities (Standard in Civil Tax Cases)

In general tax disputes, the standard of proof is on a balance of probabilities, meaning that a taxpayer must demonstrate that it is more likely than not that the tax decision is incorrect. This is consistent with the principle that tax litigation falls under civil law.

For instance, in Kenya Revenue Authority v Maluki Kitili Mwendwa, the court confirmed that unless fraud is alleged, the standard remains the balance of probabilities.

Higher Standard in Fraud Cases

Where KRA alleges tax fraud, evasion, or misrepresentation, courts have applied a higher “clear and convincing evidence” standard. In Commissioner of Domestic Taxes v Trical and Hard Limited, the High Court ruled that taxpayers accused of fraudulent tax practices (such as false invoices) must provide more than mere documentation—they must present corroborative evidence such as delivery notes, stock records, and supplier confirmations.

Similarly, in Commissioner of Domestic Taxes v Altech Stream (EA) Limited, the court held that failure to maintain accurate records weakens a taxpayer’s ability to contest a fraud-related tax assessment.

Practical Applications in Tax Administration

The burden and standard of proof in tax matters have significant practical implications in Kenya’s tax administration.

Taxpayer Compliance and Record-Keeping

Since the burden of proof rests on the taxpayer, businesses must maintain accurate and comprehensive financial records. Under the Tax Procedures Act, taxpayers are required to retain tax records for at least five years. The ruling in Commissioner of Domestic Taxes v Altech Stream (EA) Limited reinforced the importance of record-keeping, with the court holding that the failure to produce relevant records weakens a taxpayer’s case.

KRA’s Investigation Powers and the Shifting Burden

KRA has broad investigative powers, allowing it to conduct audits, request documentation, and issue additional assessments. However, once a taxpayer submits credible evidence challenging an assessment, KRA must provide substantive reasons for rejecting the evidence. In Commissioner of Domestic Taxes v Galaxy Tools Limited, the court ruled that KRA cannot rely solely on assumptions or estimates without countering the taxpayer’s evidence.

Impact on VAT Compliance and Refunds

One of the most contested tax issues involves Value Added Tax (VAT) refunds. In Commissioner of Domestic Taxes v Metoxide Limited, the court held that taxpayers seeking VAT refunds must demonstrate actual transactions beyond invoices. This means that businesses must retain supporting documentation such as payment receipts and delivery confirmations.

Combatting Tax Fraud and Evasion

In fraud-related cases, KRA bears an initial burden to present evidence supporting its claims. However, once a prima facie case is established, the burden shifts to the taxpayer. This was evident in Commissioner of Investigations and Enforcement v Pearl Industries Limited, where the court ruled that suspected tax evaders must present strong counter-evidence.

Conclusion

The burden and standard of proof in Kenyan tax cases are heavily weighted against taxpayers, requiring them to provide substantive and credible evidence to challenge tax decisions. Courts have consistently upheld the presumption of correctness in KRA’s assessments, reinforcing the statutory framework under the Tax Procedures Act and the Tax Appeals Tribunal Act.

However, the burden is not absolute—it may shift to KRA in cases where the taxpayer provides credible documentation; KRA makes arbitrary tax assessments; KRA alleges fraud; requiring higher evidentiary standards. Practically, taxpayers can protect themselves by maintaining accurate records; seeking professional tax advice and ensuring transparency in transactions.

While tax administration requires efficient revenue collection, procedural fairness remains essential in ensuring a balanced approach between compliance enforcement and taxpayer rights. Kenyan courts continue to refine these principles, reinforcing a legal framework that supports both government efficiency and fair tax practices.

Tax Compliance 101: What you need to Know about PIN Registration

Payment of taxes is one of the most universally disliked aspects of adult life. For many, the idea of handing over a portion of their hard-earned money to the government feels like an unwelcome burden, made worse by the fact that taxes are an inevitable and permanent part of our financial responsibilities. This narrative is often fueled by the perception that navigating tax procedures is confusing and overwhelming, leaving many in fear of facing penalties for unpaid taxes. At the heart of this frustration, however, lies a common thread: a lack of understanding of the tax process itself.

In today’s world, understanding taxes is essential. It is important to start taking an interest in the key aspects of tax compliance as early as 18 years old. This article aims to guide you on this informative journey, addressing common concerns that many citizens share.

Understanding Eligibility and PIN Registration

Any adult in the Republic of Kenya (18 years and above) is eligible to pay taxes. This process begins with applying for a KRA Personal Identification Number (PIN). A PIN is a unique number that the Kenya Revenue Authority (KRA) uses to identify a taxpayer and is required when doing any business, seeking employment, or even for importation.

There are two types of applicants for PINs: individuals and entities such as companies, trusts, clubs, and similar organizations. An individual's PIN starts with the code "A0…" while for entities such as companies, it begins with "P0…"

A PIN is required for activities such as applying for a Higher Education Loans Board (HELB) loan, opening a bank account, engaging in business, and selling land, among other transactions.

The purpose for which you apply for a PIN determines your tax obligations. Based on factors like your income and the nature of your application, the PIN will guide the selection of the appropriate tax categories and dictate how you will need to remit your taxes.

How to Register for a PIN: A Step-by-Step Guide

Once you have identified the need for a PIN, understanding the registration process becomes straightforward. Registration is an online process done on iTax, and it is free of charge! Residents receive their PIN certificate instantly after completing the online registration. Non-residents, however, receive an acknowledgment receipt that can be used to follow up on the registration process status.

Step-by-step guides for both individual and non-individual registration are available on the KRA website.

Tax Tips for Kenyan NGOs

Maximize Your Impact, Minimize Your Worries

Navigating taxes can feel complex, especially for Non-Governmental Organizations (NGOs) focused on making a difference. But don't worry! Understanding the tax landscape can actually boost your organization's impact. Let's unravel the mysteries together.

Good News: You Might Pay Fewer Taxes

Many NGOs in Kenya qualify for tax exemptions. That means more money to help the people you serve. But there are some rules:

Focus on Your Mission: If you are doing good things like helping communities improve or protecting the environment, you are a likely tax-exempt candidate.

Watch Out for Side Hustles: Earning money from businesses unrelated to your mission might mean paying taxes.

Get Registered for Tax Exemption

To claim those tax benefits, you need to be official:

NGO Coordination Board: Prove you are a genuine NGO.

Kenya Revenue Authority (KRA) Tax Exemption Certified: Get an Exemption Certificate after a period of operating in addition to your Personal Identification Number (PIN) to manage your taxes.

Keep Your Books in Order

Good record-keeping is your best friend:

Annual Returns: File them on time with the KRA and NGO Coordination Board.

Receipts and Records: Keep track of every shilling you spend and earn.

Not All Greener Grass

While you might save on some taxes, there are exceptions:

Business Income: Money from selling products or services unrelated to your mission might be taxed.

Investment Income: Earnings from investments can also be taxable.

Get Expert Help

Tax rules can be tricky. Consider talking to a tax expert to make sure you are doing everything right and getting the most out of your tax situation.

Conclusion

Understanding taxes can be tough, but worth it. By knowing the rules and keeping organized, you can save money and focus on what matters most: your mission.

Harnessing collective action for effective anti-corruption efforts in tax administration.

Globally, governments require a certain amount of revenue to function. The United Nations Commission on Trade and Development (UNCTAD) estimates that $5.4 trillion to $6.4 trillion is required annually from 2023 to 2030 for achievement of the Sustainable Development Goals (SDGs). This poses immense pressure on revenue administrations in implementing effective strategies in revenue mobilization to drive development. Corruption undermines the achievement of these goals particularly for revenue mobilization. This is no different for Kenya Revenue Authority.

Efficient revenue collection comes with its fair share of challenges ranging from tax avoidance to administrative inefficiencies that pave way to corrupt practices. In addressing these challenges, the Authority has put in place various measures to curb corruption including risk assessments and mitigation plans, awareness creation and corruption reporting. While these strategies have worked in curbing corruption, there is still more to be done.

In its National Ethics and Corruption Survey (NECS) 2023 report, the Ethics and Anti-Corruption Commission (EACC), made recommendations for public institutions to collaborate with strategic agencies and stakeholders for a coordinated and effective approach to tackling corruption. The complex and dynamic nature of corruption warrants government agencies, oversight bodies and businesses to act together.

In light of this, the concept of collective action emerges as a strong force in supporting anti-corruption efforts for enhanced compliance. Collective action refers to actions undertaken by individuals and/or groups towards a common purpose or goal. This can take the form of implementation of multi-stakeholder initiatives through sustained cooperation. Hence, collaboration with stakeholders such as partner government agencies, businesses, taxpayers, other revenue administrations, and oversight bodies is crucial for effectively addressing corruption.

This article explores how collective action plays a pivotal role in anti-corruption efforts and highlights its significance in promoting transparency and, accountability.

Strengthening institutional capacity: Many tax administrations, particularly in developing countries, face capacity constraints in terms of human resources, technology, and institutional capabilities. Collective action initiatives offer avenues for capacity building and technical assistance, enabling tax authorities to enhance their tax compliance efforts and strengthen their administrative systems.

An effective anti-corruption compliance program is hinged on enhancing the capacity of employees to comply with anti-corruption policies. Case in point, the Authority in cooperation with the World Customs Organization (WCO) continues to implement the WCO Anti-Corruption and Integrity Promotion (A-CIP) Programme. This involves running of capacity building initiatives to enhance the capabilities of customs administrations in addressing integrity challenges. It includes training programmes for customs officers, workshops and technical assistance programs to strengthen institutional frameworks, develop effective anti-corruption measures to improve staff integrity.

Through collective action, the Authority in collaboration with EACC has achieved this by training of Corruption Prevention Committees (CPC) and integrity assurance officers (IAOs). This enhances the capacity of employees to implement compliance obligations of the integrity program. Compliance teams also undergo training to ensure sustainability of ethical gains made and best practices. To bolster these efforts, engagements under the auspices of the East Africa Revenue Authority Committee on Integrity (EARATCI) provide practical experiences in compliance management of an anti-corruption programme in the context of tax administrations. Collective action enables implementation of the East Africa Revenue Authorities’ Integrity and Anti-Corruption Strategy where member countries share experiences, and lessons learnt in combating corruption and promoting integrity within tax administrations.

Information Exchange and Data Sharing: Information is a cornerstone of effective tax administration. Collaborative efforts for information exchange and data sharing facilitate the detection of tax evasion and the identification of high-risk taxpayers. Platforms such as the Automatic Exchange of Information (AEOI) enable participating jurisdictions to exchange financial account information automatically, thereby enhancing transparency and combating cross-border tax evasion. Similarly, initiatives like the Common Reporting Standard (CRS) facilitate the exchange of information.

Stakeholder Engagement and Public Participation: Within governmental structures, collective action takes various forms, ranging from citizen participation in decision-making processes to collaboration among different functions of government. Participatory mechanisms such as stakeholder engagements sessions, public consultations, and taxpayer engagement forums enable Kenyans to engage directly with policymakers, providing valuable input and feedback on proposed policies and initiatives. One of the key factors that lead to corruption in tax administrations is the complexity of tax and customs laws. Taxpayers rely largely on tax officials for interpretation of tax legislation. This creates a corruption loophole in situations where taxpayers are not aware of their obligations, responsibilities and services available to them for free.

Typical case is the application of the KRA PIN. The National Ethics and Corruption Survey (NECS) 2023 report highlights the application for KRA pin number as one of the services prone to bribery. In addressing this gap, concerted efforts towards taxpayer education is key in equipping citizens with required information on the application process. Platforms for taxpayer engagement and feedback mechanisms provide an opportunity for the authority to educate taxpayers on new policy changes and the service delivery charter.

International and interagency Cooperation: Tax authorities engage in international cooperation to combat cross-border tax evasion and avoidance. This involves mutual assistance agreements, joint investigations, and information-sharing agreements between countries to address tax evasion and ensure that taxpayers pay their fair share of taxes.

Collective action plays a vital role in addressing global challenges that transcend national borders in the trade facilitation arena. It warrants involvement of governments, international organizations, the private sector and other stakeholders to enhance efficiency and simplify the international trade process. The Authority through the Border Control and Operations Coordination Committee (BCOCC) continues to ensure harmonized operations at all land borders with other agencies. In carrying out the border management function, the Authority cooperates with other agencies in conducting joint border enforcement initiatives such as cargo verification, destruction of seized goods and patrols.

The nature of customs operations globally, exposes customs officials to immense corruption risks due to direct contact with people and the time sensitiveness for clearance of goods. International and interagency collaboration enables coordinated customs integrity programs to combat corruption as set out in the 10 Principles of the Revised Arusha Declaration.

Collective action in tax administrations represents a strategic approach to address the challenges of revenue mobilization, anti-corruption and tax compliance in an increasingly interconnected world. In trade facilitation, it is essential for stimulating economic growth, fostering inclusive development by facilitating the smooth flow of goods across borders and enabling businesses to access markets more efficiently. Cooperation increases the impact and credibility of anti-corruption efforts while enhancing transparency and accountability.

Through concerted efforts, tax administrations can realize their potential as catalysts for positive change, ensuring that tax revenues are mobilized efficiently and equitably for achievement of sustainable development of Kenya.
